In 2002, the Landfill (England and Wales) Regulations came into force to reduce the amount of impact landfill disposal has on the environment. Due to this regulation, your business may be prohibited from disposing certain hazardous wastes to landfills without treatment.

If you are a producer of electrical or electronic equipment (EEE), you have responsibilities under the Waste Electrical and Electronic Equipment (WEEE) Regulations.

The Waste Electrical and Electronic Equipment (WEEE) Directive which came into force in January 2007, aims to both reduce the amount of electrical and electronic equipment being produced and to encourage businesses to reuse, recycle and recover it. The Directive also aims to improve the environmental performance of businesses that manufacture, supply, use, recycle and recover electrical and electronic equipment.

Under the Weee directive it is the responsibility of every organisation to dispose of their electrical and electronic waste responsibly. DO YOU HAVE TO COMPLY WITH THE WEEE REGULATIONS?

If your product uses electricity for its main purpose, then it's likely to be covered by the WEEE Regulations which you will need to comply with.

The WEEE Regulations apply to electrical and electronic equipment (EEE) which:

•  Is dependent on electric currents or electromagnetic fields in order to work properly, including equipment for the generation, transfer and measurement of such currents and fields.

•  Is designed for use with a voltage rating not exceeding 1,000V for alternating current and 1,500V for direct current.

•  Falls into one of the 10 categories in Schedule 1 to the WEEE Regulations .
A product must satisfy all three conditions above for it to be classed as EEE.

There are a few exclusions, check the 14 categories in the finished product list. If your product does not fall into any of these categories then you don't need to comply with the WEEE Regulations.

How do the WEEE regulations affect me?

If you are an importer, re-branded or manufacturer of new electrical or electronic equipment then it is likely you'll need to comply with the UK's WEEE Regulations.
